A property sale agreement in the form of a promise of sale, for an apartment, a house or land in Jordan. It records the price, the deposit and the registration date that the buyer and the seller agree before they register the sale at the Department of Lands and Survey. It does not transfer ownership. Read the guide, then fill in the form at the bottom of the page and download a PDF or Word file.

What does Jordanian law say about a promise of sale?

  • Only registration transfers ownership: in settled areas, a transaction or contract on real estate is valid only when it is registered at the Department of Lands and Survey registration directorate. A sale that is not registered there is void.[Real Estate Ownership Law 13/2019, art. 63 · checked 31 Oct 2026]
  • A promise to make a contract in the future binds only if it sets out all the essential terms of the contract to be made and the period within which it must be made. If the law requires the contract to take a set form, the promise must respect that form too.[Civil Code 43/1976, art. 105 · checked 31 Oct 2026]
  • If the party who promised refuses to go ahead and the other party goes to court, a final judgment takes the place of the contract, provided the conditions of the contract, especially its form, are met.[Civil Code 43/1976, art. 106 · checked 31 Oct 2026]
  • A deposit (arboon) paid when a contract is made gives each party the right to withdraw unless they agreed otherwise. If the party who paid it withdraws, they lose it; if the party who received it withdraws, they return it and as much again.[Civil Code 43/1976, art. 107 · checked 31 Oct 2026]
  • Off-plan sales (an apartment sold before it is built) are to be regulated by the Department of Lands and Survey under a separate regulation.[Real Estate Ownership Law 13/2019, art. 4 · checked 31 Oct 2026]

Fees and taxes

Sale registration fees and taxes are set by law and collected by the Department of Lands and Survey when the sale is registered. This page does not quote amounts. Check the current fees with the Department before you agree who pays them.

How the template protects both sides

  • The buyer: the seller declares the property is theirs and free of any mortgage, attachment or right not disclosed in writing, and the agreement says the money paid is returned if the sale cannot be registered for a reason on the seller's side.
  • The seller: the agreement sets a last date to register the sale, and the deposit rule (arboon or part of the price) is written down.
  • Both: the agreement says plainly that it does not transfer ownership, and that ownership passes only on registration at the Department of Lands and Survey.

What Hagzi does and does not do

  • Hagzi gives you a template to fill in and download for free. We do not keep what you type into the form.
  • Hagzi does not give legal advice, notarise, certify or register the sale, does not check either party's identity or ownership of the property, and is not a party to the agreement.

Before you sign

  1. Check the title deed (land name, basin, plot and apartment number), and the seller's identity and right to sell, at the Department of Lands and Survey.
  2. Agree the price, the deposit and whether it is an arboon or part of the price, and the last date to register the sale.
  3. Have a licensed Jordanian lawyer review the agreement before any money is paid.
  4. Sign two copies in front of two witnesses, then complete the sale by registering it at the Department of Lands and Survey.
