What does Jordanian law require in a lease?
Leases in Jordan are governed by the Owners and Tenants Law No. 11 of 1994 and its amendments, the Real Estate Lease Contracts Regulation Law No. 3 of 1973, and the lease provisions of the Civil Code No. 43 of 1976.
- In writing: the lease is drawn up in writing between landlord and tenant (Lease Contracts Regulation Law, article 3). A written lease is also what lets a landlord use the urgent recovery procedure when the term ends (Owners and Tenants Law, article 19).[Lease Contracts Regulation Law 3/1973, art. 3; Owners and Tenants Law 11/1994, art. 19 · checked 31 Oct 2026]
- Required particulars: the name, family name, occupation, residence and nationality of landlord and tenant; the type of property, what it includes and how it will be used; and the term, the rent and how it is paid (Lease Contracts Regulation Law, article 4).[Lease Contracts Regulation Law 3/1973, art. 4 · checked 31 Oct 2026]
- Registration: leases are registered with the municipality or village council where the property is. The fee is half a percent of the annual rent, at least 1 dinar and at most 15 dinars, and amendments are registered too (articles 5 and 6). In Amman, the Greater Amman Municipality registers leases and lease addenda online. Confirm the fee and documents with the municipality before you apply.[Lease Contracts Regulation Law 3/1973, art. 5; Lease Contracts Regulation Law 3/1973, art. 6; Greater Amman Municipality: lease registration e-service · checked 31 Oct 2026]
- Stamp duty: a lease is subject to revenue stamp duty of three per thousand when it is registered with an official body (Revenue Stamps Fees Law No. 20 of 2001, schedule 1).[Revenue Stamps Fees Law 20/2001, schedule 1; Sanad service 691 · checked 31 Oct 2026]
- Term and renewal: leases signed on or after 31 August 2000 are governed by their own terms and end when the agreed term ends. If the lease says it renews automatically, it renews once for the same term unless the tenant tells the landlord before the original term ends that they do not want to renew (Owners and Tenants Law, article 5(b)).[Owners and Tenants Law 11/1994, art. 5(b) · checked 31 Oct 2026]
- Rent: if the lease does not say how rent is paid, it is monthly, due at the start of each month (article 12). The lease is an enforceable instrument for unpaid rent at the execution department (article 18).[Owners and Tenants Law 11/1994, art. 12; Owners and Tenants Law 11/1994, art. 18 · checked 31 Oct 2026]
- Repairs: the landlord must repair defects that affect the use of the property, and the tenant holds the property in trust and is liable for damage caused by their fault or misuse (Civil Code, articles 681 and 692).[Civil Code 43/1976, art. 681; Civil Code 43/1976, art. 692 · checked 31 Oct 2026]
- Grounds for eviction include: not paying rent within fifteen days of a notarial notice; subletting or letting someone else occupy the property without the owner's written consent; using it for another purpose; and damaging it (Owners and Tenants Law, article 5(c)).[Owners and Tenants Law 11/1994, art. 5(c) · checked 31 Oct 2026]
What Hagzi does and does not do
- Hagzi gives you a template to fill in and download for free. We do not keep what you type into the form.
- Hagzi does not notarise, certify or register the lease with the municipality or the notary public, and does not check either party's identity or ownership of the property.
- A sale is not a lease: in settled areas, a transaction or contract on real estate is valid only when it is registered at the Department of Lands and Survey registration directorate (Real Estate Ownership Law No. 13 of 2019, article 63). A promise of sale does not transfer ownership; see the promise of sale template.[Real Estate Ownership Law 13/2019, art. 63 · checked 31 Oct 2026]
How to fill in the lease
- Write the full name, national number (or passport number for a non-Jordanian), nationality and residence of the landlord and the tenant.
- Describe the property: its type, city, area, street, building number, floor and apartment number, and the plot and basin numbers if you have them from the title deed.
- If it is furnished, list the furniture and appliances in the contents field. To record the condition room by room, also fill in Hagzi's rental handover checklist and sign it with the other party.
- Set the start and end dates, the annual rent and how it is paid, and the security deposit if there is one.
- Download the lease, read all of it, check it with a lawyer if needed, then sign it with the other party and two witnesses, in two copies.
- Register the lease with the municipality where the property is.
Questions about leases in Jordan
- Does a lease have to be in writing?
- Yes. The Lease Contracts Regulation Law (article 3) requires a written lease, and fines anyone who relies on an unwritten one (article 8). A written lease also lets the landlord use the urgent recovery procedure when the term ends (Owners and Tenants Law, article 19).[Lease Contracts Regulation Law 3/1973, art. 3; Lease Contracts Regulation Law 3/1973, art. 8; Owners and Tenants Law 11/1994, art. 19 · checked 31 Oct 2026]
- Does a lease have to be registered, and where?
- Leases are registered with the municipality or village council where the property is (Lease Contracts Regulation Law, article 5). Relying on an unregistered lease before an official body brings a fine, and courts and departments delay claims until the fees are paid (articles 7 and 9).[Lease Contracts Regulation Law 3/1973, art. 5; Lease Contracts Regulation Law 3/1973, art. 7; Lease Contracts Regulation Law 3/1973, art. 9 · checked 31 Oct 2026]
- How much does lease registration cost?
- Half a percent of the annual rent, at least 1 dinar and at most 15 dinars (article 6), plus revenue stamp duty of three per thousand (Revenue Stamps Fees Law, schedule 1). Confirm the final amount with the municipality.[Lease Contracts Regulation Law 3/1973, art. 6; Revenue Stamps Fees Law 20/2001, schedule 1; Sanad service 691 · checked 31 Oct 2026]
- Does a lease renew automatically?
- A lease ends when its term ends. If it says it renews automatically, it renews once for the same term unless the tenant gives notice before the original term ends (article 5(b)). This template says renewal needs a new written agreement.[Owners and Tenants Law 11/1994, art. 5(b) · checked 31 Oct 2026]
- Does Hagzi notarise or register the lease?
- No. Hagzi only provides the template. Notarisation by the notary public and registration with the municipality are done by the parties.
